Terms of Service

These Terms are a binding agreement between you and Bigglesworth Tech Limited. They cover who can use Gaga, what you may and may not do, how purchases work, how disputes are resolved, and the limits of our responsibility. Please read them carefully — by using Gaga you agree to all of them.

Plain-language summary

Gaga pairs adults for real-time video conversations. You must be 18+, treat others with respect, and follow our Community Guidelines. We are a venue, not a party to your conversations, and you meet strangers at your own risk. We can remove content or ban accounts that break the rules. Purchases auto-renew unless cancelled. If there is a dispute, we will try to resolve it with you first, and Hong Kong law applies. This summary is for convenience only — the full Terms below are what legally apply.

01 Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the Gaga application, the website at hellogaga.com, the embedded live matching experience, and all related features and services (together, the "Service"), operated by Bigglesworth Tech Limited ("Gaga", "we", "us" or "our").

By accessing or using the Service — including by confirming you are 18 or older and launching the live experience — you agree to be bound by these Terms, our Privacy Policy and our Community Guidelines, which are incorporated by reference. If you do not agree, do not use the Service.

02 Who we are & how to contact us

The Service is provided by Bigglesworth Tech Limited, a company registered in Hong Kong (registration no. 77649784), with a registered office at Room 1911, Lee Garden One, 33 Hysan Avenue, Causeway Bay, Hong Kong. You can reach us at [email protected] for any question about these Terms or the Service.

03 Eligibility, age & restricted users

Gaga is strictly for adults. You may use the Service only if you:

  • are at least 18 years old (or the age of majority where you live, if higher) and can form a binding contract;
  • have not been previously banned from the Service and maintain only one active account;
  • are not a convicted sex offender and have not been convicted of a serious violent or sexual crime;
  • are not located in, or a national or resident of, a country or region subject to comprehensive trade sanctions, and are not on any government restricted-party, sanctions or denied-party list; and
  • are legally permitted to use a live video communication service where you live.
Zero tolerance — minors

Any attempt to use the Service while under 18, to facilitate access by a minor, or to involve a minor in any interaction results in immediate termination and may be preserved and reported to the National Center for Missing & Exploited Children (NCMEC) and to law-enforcement and other authorities.

04 Your account & registration

Some features may be available without registration, while others may require an account or verification of certain information. Where you create an account, you agree to provide accurate information and keep it up to date.

  • You are responsible for all activity that takes place through your account or device.
  • Keep your credentials confidential and notify us promptly of any unauthorised use.
  • You may not share, sell or transfer your account, create an account if we have previously banned you, or evade a ban by any means.

05 The Gaga service

Gaga is a live social-matching service that connects adults for real-time, one-to-one video conversations with other available users. You confirm your age, enter the live queue, and are paired with another person. You can leave a conversation and move to the next at any time.

The Service may evolve over time. We may add, change, suspend or remove features, impose limits, or restrict access to parts of the Service, with or without notice, to the extent permitted by law.

06 Licence to use Gaga

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use.

You may not, except as expressly permitted: copy, modify or create derivative works of the Service; reverse engineer or attempt to extract source code; resell, rent or commercially exploit the Service; use bots, scrapers or automated means; harvest data about other users; or remove any proprietary notices.

07 Acceptable use & prohibited conduct

You agree to use the Service lawfully and respectfully and to follow our Community Guidelines. Without limiting them, you must not:

  • involve, depict, contact or attempt to contact anyone under 18, or share child sexual abuse material (CSAM) — this is absolutely prohibited;
  • display nudity, sexual acts, or exposure of intimate body parts on camera, or direct sexual content at anyone without their consent;
  • harass, bully, stalk, threaten, intimidate, or engage in hate speech;
  • broadcast unlawful, violent, self-harm, or otherwise prohibited content;
  • record, screenshot, photograph or re-share another person without their consent, or share anyone's private information ("doxxing");
  • use a fake, looped or pre-recorded video feed, or misrepresent your identity or age;
  • advertise, solicit, run scams, distribute spam, or promote commercial activity;
  • transmit malware, attempt unauthorised access, or interfere with the Service; or
  • use the Service to violate any law or the rights of others.

08 Your content & live interactions

"User Content" means anything you transmit through the Service, including your live video and audio, messages and any profile information. You retain ownership of your User Content.

You grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, transmit, display, process and (where applicable) moderate your User Content solely to operate, secure and improve the Service — for example, to deliver your live stream to the person you are matched with and to detect and act on violations. We do not claim ownership of your User Content and do not use it for advertising. This licence ends when your User Content is deleted, except to the extent it has been shared with others or must be retained for safety, legal or enforcement purposes.

You are solely responsible for your User Content and your conduct, and you represent that you have all rights necessary to share it and that it does not violate these Terms, our Community Guidelines, or any law or third-party right.

09 Interactions with other users; assumption of risk & release

Gaga is a venue that connects you with other adults. We are not a party to, and are not responsible for, your interactions with other users, whether on or off the Service.

  • No background checks. We do not conduct criminal background checks or identity verification on users, and we make no representation about any user's conduct, identity, age or background. You are responsible for taking reasonable precautions in all interactions.
  • Assumption of risk. Meeting and communicating with strangers carries inherent risks, and you assume those risks when you use the Service. Never share sensitive personal, financial or identifying information during a live conversation.
  • Release. To the fullest extent permitted by law, you release us and our affiliates, officers, employees and agents from any claims, demands, damages or liabilities of every kind arising out of or connected with any dispute, interaction or conduct between you and any other user, online or offline.

10 Safety, reporting, blocking & moderation

Safety is central to Gaga. We provide controls to report, block and leave any interaction, and we use a combination of automated systems and human review to enforce our rules.

  • If something is wrong, select a reason, then leave or block the user. Serious matters can be escalated to [email protected].
  • To keep the community safe, we take periodic screenshots of live sessions for automated and human moderation. Screenshots that show no violation are deleted within 3 days; those linked to a violation may be retained longer. See our Privacy Policy for details.
  • We may review reported interactions and, where necessary and lawful, retain limited evidence to investigate, enforce our Terms, and cooperate with authorities.
  • Suspected child sexual exploitation is preserved and reported to NCMEC and/or relevant authorities as required by law.
  • We may remove content and warn, restrict, suspend or permanently ban accounts that breach these Terms or our Community Guidelines, at our reasonable discretion.

Reporting tools are not a substitute for emergency services. If you believe someone is in immediate danger, contact your local emergency number.

11 Purchases, subscriptions & automatic renewals

Where offered, the Service may let you buy subscriptions or one-time products. The following applies to all purchases:

  • Auto-renewal. Subscriptions automatically renew for successive periods at the then-current price until you cancel. We disclose price and billing frequency before you buy and obtain your affirmative consent to the recurring charge.
  • How to cancel. You can cancel at any time, and we make cancellation at least as easy as signing up ("click to cancel"). For purchases made through an app store (Apple App Store or Google Play), you must cancel through that store; for purchases made directly with us, you can cancel in the Service or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. Where required by law, we will send renewal reminders before charging you.
  • App-store purchases. Purchases made through an app store are also governed by that store's terms, and refunds for those purchases are handled by the store.
  • Refunds & withdrawal rights. Except where the law requires otherwise, payments are final and non-refundable. Where mandatory law grants you a withdrawal or cooling-off right — for example, the 14-day right of withdrawal in the EU/EEA and UK, the 7-day right in South Korea, or a 3-business-day right in certain US states — those rights apply. For digital content and services supplied immediately, you may be asked to consent to immediate performance and acknowledge that your withdrawal right is lost once performance begins.
  • Price changes. We may change prices; changes apply to future billing periods and we give advance notice where required by law.

12 Virtual items

The Service may offer virtual items, credits or coins ("Virtual Items"). Virtual Items are licensed, not sold, and:

  • have no monetary value and cannot be exchanged for cash;
  • are non-transferable and non-refundable except where required by law;
  • may expire, and may be managed, regulated, modified or discontinued by us at any time; and
  • are forfeited when your account is terminated or closed, except where the law requires otherwise.

13 Intellectual property

The Service, including its software, design, text, graphics, logos, the "Gaga" and "Hello Gaga" names and marks, and all related intellectual property, are owned by us or our licensors and are protected by law. Except for the limited licence granted to you, no rights are transferred to you.

14 Copyright complaints & DMCA

We respect intellectual-property rights and respond to clear notices of alleged copyright infringement. Where the U.S. Digital Millennium Copyright Act (DMCA) or a similar law applies, and to the extent we maintain a designated agent, you may send a written notice of alleged infringement to [email protected] that includes:

  • your physical or electronic signature;
  • identification of the copyrighted work and the allegedly infringing material, with enough detail to locate it;
  • your contact details;
  • a statement that you have a good-faith belief the use is not authorised; and
  • a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act on the owner's behalf.

Where applicable, we may remove allegedly infringing material, offer a counter-notice process, and terminate the accounts of repeat infringers.

15 Third-party services & links

The Service may rely on or link to third-party services (for example, the embedded live matching surface, app stores, or payment processors). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.

16 Privacy

Our Privacy Policy explains what information we collect, how we use it, how live video and moderation screenshots are handled, international transfers, and the choices and rights you have. By using the Service you acknowledge that policy.

17 Electronic communications & notices

By using the Service you consent to receive communications, agreements, disclosures and notices from us electronically — in the Service, by email, or by posting to this website — and you agree that electronic communications satisfy any legal requirement that such communications be in writing. You may withdraw consent for non-essential communications, but doing so may affect your ability to use parts of the Service.

18 Suspension & termination

You may stop using the Service at any time and can request deletion of your account — see Delete account. We may suspend or terminate your access immediately, with or without notice and without refund, if you breach these Terms, if required by law, or to protect the Service or other users. On termination, the licence granted to you ends, Virtual Items are forfeited, and the sections that by their nature should survive (including sections 8, 9, 13, 19–23 and 25) continue to apply.

19 Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied or statutory, to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that any defects will be corrected, or that the conduct, identity, age or content of other users will meet your expectations or be lawful.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence or for fraud.

20 Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, including the conduct of other users.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us, if any, in the twelve months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

21 Indemnification

You agree to indemnify and hold harmless Bigglesworth Tech Limited and its affiliates, officers, directors, employees and agents from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, your interactions with other users, your violation of these Terms, or your violation of any law or third-party right.

22 Dispute resolution

We want to resolve any concern quickly and fairly. Before starting court proceedings, please contact us at [email protected] with a description of the issue and the outcome you would like, and give us a reasonable opportunity (at least 30 days) to resolve it with you.

If we cannot resolve a dispute informally, it will be subject to the governing law and courts set out in section 23. If you are a consumer, you keep the benefit of the mandatory laws of your home country, including any right to bring proceedings in your local courts. Claims of sexual assault or sexual harassment are not subject to the informal-resolution step and may be brought directly.

23 Governing law & venue

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. Subject to section 22, the courts of Hong Kong have non-exclusive jurisdiction. Mandatory consumer-protection laws of your country of residence may also apply, and nothing here deprives you of the protection of those laws.

24 Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms here with a new "Last updated" date or providing in-app notice; material changes to the liability or arbitration sections may require your affirmative acceptance. Changes take effect when posted unless stated otherwise, and your continued use of the Service after they take effect constitutes acceptance.

25 General terms

  • Entire agreement. These Terms, with the Privacy Policy and Community Guidelines, are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
  • Survival. Provisions that by their nature should survive termination will survive.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
